By completing payment of the booking fee, you are agreeing to the following terms and conditions.
APPLICATION OF TERMS
Terms & Conditions apply exclusively to every booking agreement with any client, and all quotations are made, and all orders are accepted on and subject to these Terms & Conditions. No terms introduced by the customer shall take priority over the Company’s Terms & Conditions.
PAYMENTS
Payments can be made via BACS transactions and Credit Cards via Stripe. We charge a 1.4% fee +20p for UK cards and a 2.9% fee +20p with international cards for processing payments with stripe. Please visit Stripe for payment processing rates for your country.
BALANCE DUE
The final balance amount is due one month before the event date. Any method of payment on the event date will not be accepted. Services will not be supplied to the client if the balance due amount has not been paid in full.
BEHAVIOUR
The client is held fully responsible for their and their guest’s behaviour. Videographers will not tolerate abusive clients and/or guests and will cease production in the event of threatening behaviour. We reserve the right to end all services early, without prior notice or refund, in the interests of personal safety.
BOOKINGS
Bookings are accepted on the completion of the booking contract and the payment of the booking fee. This can be paid via bank transfer or cheque. Non-returnable booking payment is required to book.
CONSENT
The client is fully responsible for ensuring that all consents are provided and any required fees paid so that the videographer can carry out the agreed service. (This does not include drone permissions) This includes, but is not limited to, permission to film in the church/venue and permission to film persons involved, i.e. musicians and entertainers.
The videographer must be notified of any consent issues at least seven days prior to the event.
Dinner is appreciated but not expected. If dinner is not provided, a minimum one-hour break will be permitted.
PROMOTION
The client will allow Michael Westcott Films to display any imagery related to the event for the purposes of advertising and promotion.
COMPLAINTS
In the event of any complaint, the client should attempt to rectify the problem with the videographer on the date of the event. Where this is deemed not possible, complaints should then be made in writing within 30 calendar days of the event date. Complaints will be fully investigated, and a response will be made available to the client within ten calendar days.
EQUIPMENT OPERATION
Only company staff may operate company equipment. Under no circumstances may unauthorised personnel tamper with, move or attempt to use the equipment owned by the videographer. We cannot accept any responsibility for damage caused to the event venue or injury caused to the client, guests and/or venue staff caused directly by third-party intervention.
FORCE MAJEURE
The client agrees that Michael Westcott Films shall not be liable for any and all losses, including damages, costs, claims, compensation and other liabilities which arise as a result of any delay or interruption in, or any non-delivery, missed delivery or failure of the equipment and/ or services due to circumstances beyond our or any of our suppliers and contractors reasonable control (including, but not limited to, fire, lightning, explosion, war, disorder, flood, industrial dispute, sabotage, weather conditions, road closure, vandalism, traffic congestion, vehicle failure or acts of local or central government or other competent authorities).
Our maximum liability arising out of or in connection with the non-supply of services on the event date and at the venue location shall be limited to the total value of the booking agreement fee in pounds.
GENERAL
The booking agreement shall be governed by and construed in accordance with the laws of England and Wales, and you agree to submit to the exclusive jurisdiction of the courts of England and Wales. In the event that the agreement is translated into any other language, the English language version shall prevail. You may not assign or sub-contract any of your rights or obligations under these terms and conditions or any related order for products to any third party. If any portion of these terms and conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity or enforceability of the other sections of these terms and conditions shall not be affected.
HEALTH AND SAFETY
It is the responsibility of the client to ensure the venue complies with current Health & Safety Regulations and holds all necessary certifications, including Public Liability Insurance, Public Performance Licenses, and, where applicable, relevant PAT test certification. Michael Westcott Films ensures that equipment fully complies with the relevant and current Health & Safety legislation regarding the equipment and company staff. It is the responsibility of the client and/or venue to provide a safe & suitable area within the venue location to facilitate the installation of equipment. Any floor surface, staging, mounting area or electricity supply which is deemed unsuitable or unsafe by the videographer may delay or prevent the installation of equipment. If the installation cannot be completed successfully, the client cannot be provided with any Services. In this event, no refunds, in part or full, will be given for the non-use of equipment that cannot be used due to any Health & Safety implications imposed on the videographer by the client and/or venue.
ILLNESS & ACCIDENTS
In the event of an accident or illness preventing the videographer(s) from appearing, the client shall be informed at the earliest opportunity, and if requested by the client, medical evidence will be provided. The client will not be obliged to pay a fee for any services the videographer is unable to provide. An attempt to hire other shooters who I know and trust will be made at the client’s agreement. Lastly, other suppliers will be recommended to transfer the booking over, and a full refund will be made to the client.
PRICES AND QUOTATIONS
All package prices are fully inclusive of delivery, labour, and insurance. Quotations are valid for seven days.
CANCELLATIONS
The client reserves the right to cancel the booking agreement at any time by doing so in writing to Michael Westcott Films. Any initial booking fee paid is non-returnable. Cancellations made within the following time scales will also be liable for the following further cancellation charges:
Number of Days’ Notice Given – Cancellation Charge Amount Due
· 60 Days or less – 50% of the Balance Due Amount.
· 30 Days or less – The full value of the Balance Due Amount.
Cancellations must be made in writing or emailed by the client. For security reasons, they will not be accepted over the phone.
FILMING
Michael Westcott Films will be the exclusive professional videography service in attendance. Friends and family are permitted to operate video cameras on the condition that they do not interfere with or get in the way of professional coverage.
Creative aspects such as shooting and editing are at the videographer’s discretion.
VENUE ACCESS
The client and/or venue must make at least one safe & suitable parking space available to the videographer, at no cost to Michael Westcott Films, to facilitate safe & prompt unloading of the equipment. The client shall notify the videographer at least 14 calendar days prior to the event date if this is unavailable. In this event, the Company reserves the right to make its own parking arrangements and charge this cost in full to the Hirer.
Deposits of 25% must be paid to secure bookings, and the remaining balance must be paid one month or no later than seven days before the day of the wedding.
I/we have read and agree to the terms and conditions printed on this contract and have accepted them.
TRAVEL
We include a 100-mile radius from where we stay (currently in Aberdeen), and anything out with this boundary is charged at 45p/mile. This cost will be added to the total quote on the last payment due.
Wedding Video FAQs
Please read through these questions and answers. If you have questions that are not clear after reading the following items, please feel free to contact your principal photographer/videographer.
Q. If I want to be filmed at the salon while getting ready, what do I have to do to be able to have your record at a salon?
A. If you are planning on getting ready at a beauty salon, it is always a good idea to check in advance to see if they will allow you to take photographs/videos in their building.
Q. Is it possible to video everyone at the wedding ceremony and reception? How long do you work with me on the day of our wedding?
A. No. It is impossible to guarantee that everyone will be filmed. As a general rule, with my videos, I focus on the bride and groom. If you want to ensure that a specific family member is filmed, you must let me know before the wedding day.
Q. Can we buy the raw footage? How long do you keep a master copy of our video on file?
A. Yes. You can select this from the add-ons listed on my website for £750. Michael Westcott Films posts the footage on a hard drive, first class recorded, which is included in the above price. Michael Westcott Films keeps a master copy of the raw footage for a year after the wedding date.
Q. How long does it take to finish editing our video? Can we make changes to the final video?
A. I will finish editing your film within six months. Longer times can be expected during busy seasons. Quality will not be compromised as I ensure every film is produced to its highest quality possible. I would apply changes to the final video only if mistakes were made on Michael Westcott Films’ part. Such mistakes include misspellings. Other changes to the final video can be made, but there will be a charge per hour to do so. Changes to the final video, which were not caused by Michael Westcott Films, are billed at a rate of £50 per hour with a minimum of 2 hours charged. These charges are not meant to be a deterrent, but changes to the final video that were not discussed with me ahead of time still take a great deal of additional editing time and excess materials.
Q. How do we get our wedding videos when you are finished?
A. When I inform you that your video is finished via email. I will send over a private YouTube link to watch the Feature / Trailer / Highlights and Teaser Films. I will then send over a private Playbook link where you can download the files to your computer. If you opted for Package Three, then you will have a private online gallery to view and download your films which are provided via WedFlow.
